Terms

Section 1 Scope

These Terms of Service apply to the use of the AI assistant Aiory at aiory.app ("Aiory" or "the service"), operated by Marcel Herczog, c/o POSTFLEX PFX-837-041, Emsdettener Straße 10, 48268 Greven, Germany ("provider").

Aiory is an AI assistant for everyday and office tasks. The service includes in particular an AI chat and additional assistive tools; the scope of services is described in Section 2.

These terms become part of the relevant user or subscription agreement when the user is informed about them before conclusion of the agreement, has the opportunity to review them and confirms their validity.

Section 2 Services

Aiory includes in particular the following functions:

  • AI chat — conversational assistant with live web search for up-to-date questions
  • AI image generation — creation of images at the user's explicit request
  • File uploads and document analysis — uploading and AI-supported evaluation of files and documents
  • Cloud storage — storing and managing your own files
  • Online office — editing office documents (e.g. .docx, .xlsx, .pptx) and PDF files in the browser
  • Appointments, reminders and AI automations — managing appointments, reminders and recurring tasks
  • Letter creation — drafting letters with PDF export
  • Everyday widgets — for example weather, product search and travel information

Aiory does not send emails or letters. Letters and documents are only created and provided as files (for example PDF) for download or for storage in the cloud storage; sending them is the user's responsibility.

The specific scope of services — in particular the weekly usage quotas — depends on the selected plan (Section 4) and on technical and organizational requirements.

Section 3 Registration and Agreement

Registration is possible using an email address or by signing in with Discord, Google or Apple. Upon successful registration and confirmation of these terms, a free user agreement for the Aiory Basic plan is concluded.

The minimum age for using the service is 13 years. Users under the age of 18 may only use Aiory with the consent of a parent or legal guardian; by registering, they confirm that such consent has been given. Paid plans may only be purchased by users who have reached the age of majority. Registration with false information is not permitted. Each user may operate only one account.

Section 4 Plans and Prices

Aiory offers the following plans:

  • Aiory Basic (free) — basic functions with a small quota
  • Aiory Go (EUR 9.99/month)
  • Aiory Plus (EUR 14.99/month)
  • Aiory Pro (EUR 24.99/month)

All paid plans include the same set of features. They differ in the usage quota for AI requests and the quota for AI images (each Go : Plus : Pro = 1 : 2 : 4), the quota for the document AI and for voice conversations, cloud storage (10 / 25 / 60 GB) and the number of simultaneously active AI automations (2 / 5 / 10). All quotas apply per usage week: seven days, each starting on a fixed weekday assigned to the account. At the start of every usage week the quotas are fully available again; unused quota expires at the end of the usage week. Aiory shows this weekday in the account area. The pricing page states the specific guide values (such as “about 105 AI requests per week”).

Use after the quota is exhausted. Once a week's quota is used up, access does not end: Aiory continues to answer general requests, but using a simpler language model. A notice is shown in the chat. Web pages you provide are still retrieved and summarized. Requests for up-to-date facts — such as official amounts, deadlines, prices or current events — are not answered in this state; Aiory indicates when the full quota becomes available again. To prevent abuse, a weekly upper limit applies; once reached, the simplified answering also pauses until the following week begins (Monday).

The free Aiory Basic plan is available for trying out Aiory. Paid subscriptions start when the contract is concluded and are charged immediately.

All prices include statutory VAT. The provider may adjust prices with 30 days' notice. Existing subscriptions remain at the previous price until the next renewal.

If a subscription is taken out in the iOS app via the App Store or in the Android app via Google Play, the prices shown there apply; they may differ from the prices on the website.

Section 5 Payment and Billing

For subscriptions taken out on the website, payments are processed by the payment service provider Stripe. For subscriptions taken out in the iOS app, payment is handled by Apple (in-app purchase in the App Store), and in the Android app by Google Play; Apple's or Google's terms apply additionally to these subscriptions. The selected package is billed as a recurring monthly subscription.

At the beginning of each billing period, the agreed amount is automatically charged unless the subscription was cancelled in time for the end of the current period.

The user is required to provide valid payment details. If a payment fails, access to the selected package may be temporarily restricted.

Voucher and coupon codes may be redeemed during checkout and reduce the price according to the relevant campaign terms.

Section 6 Cancellation

Paid Aiory subscriptions can be cancelled at any time with effect at the end of the current billing period. There is no minimum term. Cancellation can be made through account management in the service or by email to kontakt@aionity.app (Aiory and Aionity are offerings of Marcel Herczog, sole proprietor). Subscriptions taken out via the App Store or Google Play are cancelled in Apple's or Google's subscription settings.

After cancellation, access to the booked plan remains active until the end of the paid period or the current billing period. Afterwards, the account is automatically switched to the Aiory Basic plan.

A scheduled cancellation can be revoked until the end of the current billing period.

The provider may terminate the user relationship with 14 days' notice to the end of a month, or without notice in the event of a breach of these terms.

Section 7 Right of Withdrawal

Consumers have a statutory right of withdrawal when concluding a paid distance contract (a paid Aiory subscription taken out through our website). For subscriptions taken out via the App Store or Google Play, the withdrawal rules of Apple or Google also apply.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Marcel Herczog, c/o POSTFLEX PFX-837-041, Emsdettener Straße 10, 48268 Greven, Germany, email: kontakt@aionity.app) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Section 8 User Obligations

The user agrees to:

  • use the service only in compliance with applicable law
  • keep login credentials confidential and not disclose them to third parties
  • not use automated access such as bots or scrapers without explicit permission
  • not upload, create or distribute content that violates applicable law or the rights of third parties
  • not use the service in a way that impairs operation or other users

In case of violations, the provider may temporarily or permanently suspend access.

Section 9 AI-Generated Content

Aiory creates answers and content using artificial intelligence. AI-generated answers, texts, images and documents may contain errors or be incomplete or outdated. The user is required to verify important information and created documents before using them.

The content provided by the service does not constitute legal, tax, investment or medical advice. If you have health concerns, please consult a doctor; in an emergency, call your local emergency number. The user is solely responsible for decisions made on the basis of AI-generated content; the liability rules in Section 10 remain unaffected.

Section 10 Availability and Liability

The provider makes reasonable efforts to keep the service available without interruption. There is no entitlement to constant availability. Maintenance, technical disruptions or force majeure may cause temporary outages.

The provider's liability is limited to intent and gross negligence. In cases of slight negligence, the provider is liable only for breach of essential contractual obligations and limited to foreseeable, contract-typical damage. This does not apply to damage arising from injury to life, body or health.

Section 11 Intellectual Property

All content of the service, including text, graphics, logos, our own software and databases, is protected by copyright. Any use beyond the intended use requires the provider's prior written consent.

The provider does not acquire any rights of use in content uploaded by the user or created with the help of the service beyond what is necessary to provide the service.

Section 12 Final Provisions

The law of the Federal Republic of Germany applies. If individual provisions of these terms are or become invalid, the validity of the remaining provisions remains unaffected.

The provider may amend these terms with effect for the future where objectively necessary, in particular due to changes in law, technical conditions or the scope of services.

Registered users will be informed of changes in good time. If the user does not object to a notified change within a reasonable period and is expressly informed of this consequence in the change notice, continued use of the service after the change takes effect may be deemed acceptance. Statutory rights remain unaffected.

The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
